The New Hampshire House Republicans recently passed HB148 which: Allows the classification of individuals based on biological sex in three specific areas under New Hampshire law, even if this classification might be otherwise discriminatory based on gender identity for:
Lavatories and Locker Rooms
Public or private entities may legally designate restrooms or locker rooms for use by biological sex, even when the facilities include individual stalls or urinals.
Athletic and Sporting Events
It would not be unlawful discrimination to separate participants by biological sex in athletic competitions where strength, speed, or endurance are generally recognized to give an advantage to biological males.
Detention and Treatment Facilities
Prisons, juvenile detention centers, mental health institutions, and similar involuntary commitment facilities may classify and house individuals based on biological sex, rather than gender identity.
The bill’s sponsors assert that while the state remains committed to nondiscrimination and equal dignity, there are “limited circumstances” in which classifying people based on biological sex serves the “compelling state interests” of protecting privacy rights and ensuring physical safety.
This bill is now on it's way to the New Hampshire Senate, but we are interested in our reader's opinions (feel free to leave comments below):
